A used motor vehicle dealer cannot exclude or disclaim the implied warranty of merchantability until midnight of the fifteenth calendar day after delivery or until the vehicle is driven 500 miles after delivery, whichever is earlier (A.R.S. 44-1267). Trying to do so makes the purchase agreement voidable at your option. (source: Arizona State Legislature)

The warranty is met if the vehicle functions in a safe condition and is substantially free of any defect that significantly limits its use for ordinary transportation on public highways. It does not cover damage after the sale from abuse, neglect, failing to maintain oil or coolant, off road use, racing or towing. (source: Arizona State Legislature)

If the warranty is breached, give the seller reasonable notice. The seller gets a reasonable opportunity to repair. You pay half the cost of the first two repairs, up to $25 per repair, and the seller's maximum liability is the purchase price. A purchaser can waive the warranty only for a particular defect that the dealer fully discloses, by signing a bold statement on the first page of the sales agreement. A "used motor vehicle dealer" means a seller who sold or offered four or more used vehicles in the previous twelve months. (source: Arizona State Legislature) (source: Arizona State Legislature)

Before a used car sale, a dealer must give you a written statement, set off in bold type, that says whether an express warranty comes with the car, or says "as is" if it does not. That statement does not cancel the implied warranty in A.R.S. 44-1267 (A.R.S. 28-4412). (source: Arizona State Legislature)

The Attorney General suggests having a trusted mechanic inspect a used vehicle before you buy, even if the dealer says it was already inspected. (source: Arizona Attorney General's Office)
